DUI/DUID Silver Bullets.

Just like the Vampire hunters of legend and lore this session will provide today’s DUI/DUID hunters with the “silver bullets” to control and overcome the sometime troublesome DUI/DUID defense attorney. Attendees will also learn how to better prepare for victory at trial through innovative roadside investigations and interviews involving conversation rather than interrogation with a study of suggested question strings for use roadside with alcohol and drug impaired drivers along with a discussion of the importance of the timing of that questioning. Included will be direct testimony techniques for officers and prosecutors that will make the SFSTs and signs of drug impairment relevant to the jury. Attention will also be paid to follow up investigation used to build a winning case through more complete evidence gathering. Appropriate for Keynote /Plenary sessions as well as breakouts. "It's Not Just an Accident!" - Vehicular Homicide, the "Accepted" Murder

Some prosecutors and courts treat vehicular homicides as "tragic accidents" rather than serious forms of murder. This presentation will examine the cause and effect of these misconceptions, evaluate the true seriousness of these crimes and reflect upon changing attitudes and finding solutions. Impaired Driving Eye Signs – Seeing is Believing

Horizontal Gaze Nystagmus, Vertical Gaze Nystagmus, Rebound Dilation, Eyelid Tremors, and other eye signs are commonly exhibited by impaired drivers. Usually only law enforcement officers and medical professionals have observed these clues. This sometimes leads others to doubt the existence of these eye signs or the ability of anyone other than a medical professional to recognize them. This presentation will allow the audience to see theses clues using DAX Video Eye Sign Recorder video from actual roadside impaired driving investigations and Drug Recognition Expert Evaluations. Appropriate for Less experienced Law Enforcement, Judges, Magistrates, Toxicologists, and Prosecutors as well as Civic Groups. (1 hour).

Sovereign Encounters

Sovereign Citizens can be both obstinate and persuasive, obstructive and seemingly cooperative, apparently harmless and downright deadly. As a result officers on the road and at sobriety check points, as well as Judges, prosecutors and clerks in court are often confused, hesitant, distracted and therefore vulnerable during these interactions. Staying safe is your number one priority. Holding them accountable and doing justice is the second. Due to their confusing yet somewhat official looking pleadings they may be given unusual latitude in the courtroom. In this session we will learn what to expect during an encounter with sovereigns and how to more safely and effectively deal with them. Am I Detained?

Thanks to mobile devices, the internet is loaded with videos taken by suspects in traffic stops. This footage sometimes shows officers in a less than favorable light. Explore specific problem scenarios encountered by officers during these events including attempts by suspects to “set up” the officer for a civil lawsuit claiming a breach of constitutional rights, baiting the officer into violence or other improper conduct and challenging officer’s overall authority and techniques to handle them. Fourth Amendment principles will also be discussed as they relate to the contact and detention of suspected impaired drivers. (1 hour).

Cross-Examination of the Expert Witness

Effective cross-examination requires extensive preparation. This is especially true when the defense witness is recognized as an expert. Not only does the expert witness possess specialized knowledge the prosecutor may lack but they routinely have better developed communication skills and greater cross-examination experience than the average witness. As a result preparation for the defense expert is much different than for an ordinary cross-examination. Courtroom Success for DREs - Witness Skills Training

Many DRE officers who work on impairment cases are under-trained in the skills needed to provide powerful, persuasive testimony at trial. Without formal training focusing on the procedures of the trial, the rules of the courtroom, the expectations of the jury, etc. many officers have to rely on their instinct to be the best witness they can. COURTROOM SUCCESS for DRE’s training gives officers a foundation and structure to support their individual styles, and goes far beyond the “how to dress” and “where to look” rules they’ve already been told to observe. In fact the U.S. Fire Administration reported that approximately one third of human trafficking victims are treated by medical providers yet less than one half of EMS providers have ever received training on how to identify this vulnerable population. The presentation will include a review of the various pathognomonic signs of child abuse and neglect including but not limited to Abusive Head Trauma (Shaken Infant Syndrome) and Munchausen’s Syndrome By Proxy.

Students will achieve a working understanding of the court system and their role in it relative to the investigation, prosecution and trial of child abuse cases as well as their responsibilities as a mandatory reporter. (2-4 hours).
